Moment to SHINE – Share Your SHINE Contest Begins Sunday, June 15th


Entry Rules

Entrants should read the following Entry Rules and General Terms and Conditions carefully before submitting entry/entries. Submission of entry/entries signifies that the entrant accepts the “Moment to SHINE Share Your SHINE” Contest Rules.

How to Enter
• Register on www.MomentToShine.com.
• Complete the entry form with information and contact details.
• Story submissions are entered online in accordance with the instructions on the website. Type a SHINE story about what makes you SHINE, who makes you SHINE, what brightens your day, or what lifts your spirits. Limit: 350 words or fewer.

Age Categories
Must be thirteen (13) years of age or older to participate.
Story submissions will be divided into two age categories:

• 13 to 20
• 21 and over

Entry Period
• Submission Period: Sunday, June 15 to Monday, October 15, 2008
• All entries must be posted and received by midnight EST on October 15, 2008
• Voting Period: a two-week period will be established for final voting after submission of entries has ended and all approved stories have been posted.

Acceptance Criteria
All submitted stories that meet the Organizer’s criteria will be approved and posted on the SHINE Contest website. An approval email will be sent to the entrant. Approval of submitted story officially and automatically enters the entrant into the Contest.

Rejection Criteria
The Organizer reserves the right to reject any work it deems inappropriate for publication on its website, Reasons for rejection could be inappropriate subject matter/content, use of inappropriate language/ profanity, or other. If entrant’s story submission is rejected, the entrant is not enrolled in the Contest. A rejection email will be sent to the entrant if submitted story is rejected.

The Organizer has the right to reject and not post a submission that is entered by anyone who is under the age of 13 or not a legal participant.

Judging Criteria
The winners will be selected by public vote. Voting will take place online only and is based upon a 5-point rating system. To vote, a person must be a registered user on the Contest website.

Voting/Rating Process
Works will be judged based upon a 5-point scale voting/rating system, with the lowest rating being no stars and the highest rating being five stars. At the end of the official voting period, the story submission with the highest ranking and number of votes will win.

Participants may vote/rate multiple stories. Only one vote per story per user allowed.

Once a vote/rating has been entered on a story it cannot be changed.

In case of a tie or if no clear winner has been determined by the end of the public voting period, the Organizer will hold a tie breaker vote amongst Bank of the Carolinas employees.

Prize
One (1) $500 cash prize will be awarded by official check to the winner.

Contest Winner
• The winner will be notified by the Organizer by November 3, 2008.
• The winner will be announced and winning stories will be exhibited on the Organizer’s
website. Bank of the Carolinas reserves the right to publish and use the winning stories
for publicity purposes.
• The Organizer will not respond to any inquiries about the selection process and/or the results.
• Attendance at the time of announcement is not required to claim a prize.
• All expenses incidental to attendance at any SHINE events, ceremonies, or appearances brought forth by entering or winning the Contest shall be borne by the winners.

General Terms and Conditions
Submissions can be entered by individuals who are over the age of thirteen (13). The Contest is open to anyone, regardless of sex or nationality, who is a legal citizen of the United States of America, except for employees of Bank of the Carolinas and their immediate family and household members. Bank employees and their immediate family will be able to submit SHINE stories; however, they are not eligible to win.

Multiple entries may be accepted from one entrant.

All entrants must complete all required data requested on the entry form. Incomplete or inaccurate entry forms will not be accepted.

Submitters must be the creator/author of the submitted work (story), holding the full copyright ownership therein.

Submitted stories must be original works that have not been previously published nor publicly displayed or exhibited. A story or written work that has won a prize in any other competition of any nature is not eligible for entry.
Works that Organizer deems, in its sole opinion, to be created for the purpose of being sales promotions, or to be a direct or indirect result of commercial activity, are not eligible for entry.

Copyright to the entries belongs to its respective creator. However, each entrant expressly agrees that the Organizer and its licensees may publish, reproduce, display, exhibit, print, distribute, or edit, in any media, such entries, as well as each winning entrant’s name and image and likeness (except for children under 17, unless prior parental consent has been obtained), for the purposes of promotion and public relations for the Contest (including its future sequels), and its results, at no charge, anywhere in the world in perpetuity.

Each work will be identified by its title and the entrant’s established username.

Once submissions are accepted and posted by the Organizer, no changes can be made to the submitted written story or selected SHINE icon.

The Organizer reserves the right to publish and/or remove any content on this or any other company website.

The Organizer reserves the right, in its sole discretion, to cancel or suspend part or all of the “Moment To SHINE” Online Contest should virus bugs, non-authorized human intervention, or other causes beyond the control of the Organizer corrupt or impair the administration, security, judging, or fairness of the Contest.

The Organizer is not responsible for technical, hardware, software, or telephone failures of any kind; lost or unavailable network connections; fraud; or incomplete, garbled, or delayed computer transmissions, whether caused by the Organizer, users, or by any equipment or programming associated with or utilized in the Contest or by any technical or human error.

It is expressly acknowledged that the prize money set forth above shall be inclusive of any and all
applicable withholding and governmental taxes and award winners shall be responsible for payment of any relevant tax or transmittal charges that may be incurred from receipt of such rewards.
If the entrant fails to comply with the term of the Rules, the Organizer reserves the right to immediately disqualify the entry, as well as the right to cancel the award and to demand the return of awards and award money, without prejudice to recovery of any further damages.

The Organizer reserves the right to determine items not covered in the Rules. If the entrant does not agree with such decision, the entrant may withdraw from the Contest.

The Rules shall be governed by and construed in accordance with the laws of the United States of America, excluding its conflict of law rules. Each entrant expressly agrees that the exclusive jurisdiction for any claim or action arising out of or relating to the Rules or the operation of the Contest shall be subject to the exclusive jurisdiction of the District Court of North Carolina.

Unless otherwise specified herein, the Rules constitute the entire agreement between the entrant and the Organizer with respect to the Contest and supersede all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between them with respect to the Contest. If any part of the Rules is help invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties and the remaining portions shall remain in full force and effect.

No purchase necessary to enter.

This Contest is void where prohibited by law.

Collection of Personal Information
When you make an entry of your work through this site, the Organizer needs your personal information by which you can be identified, such as address, name, or phone number (“Personal Information”). You can choose not to provide certain Personal Information, but then your entry may not be accepted.

The Organizer does not accept entries online from those who are under 13 years old. If you are under 13 years old, please discuss entering the Contest with your parents. If you would like to enter, have your parent register and submit a story on your behalf as a group entry.

The Organizer will not disclose Personal Information (including full name) received from Contest entrants under 17 years old without parental consent.

Use of Personal Information
The Organizer uses your personal information (i) to notify you about this Contest and (ii) to contact you to ask about your submitted story.

The Organizer will also use your personal information when notifying you about other events and similar contests the Organizer holds in the future.
